A Failure of Capitalism: The Crisis of '08 and the Descent into Depression
Richard A. Posner, 2011
The financial and economic crisis that began in 2008 is the most alarming of our lifetime because of the warp-speed at which it is occurring. How could it have happened, especially after all that we’ve learned from the Great Depression? Why wasn’t it anticipated so that remedial steps could be taken to avoid or mitigate it? What can be done to reve...

The Behavior of Federal Judges: A Theoretical and Empirical Study of Rational Choice

The Behavior of Federal Judges has the potential to radically reorient the entire field of research into judicial behavior, one of the most exciting fields in law, economics, and political science. Is it realistic to think that federal spending can be cut substantially in either the short or the long run? Posner - The Becker-Posner Blog
The answer, I think, is no, provided the focus is limited to the short run—the next few years. For it’s impossible to predict federal spending in the more distant future; there are too many imponderables. Many predictions of federal spending are published, by federal agencies and financial analysts, some for as far out as 2050, but I don’t think they have any value, given the volatility of American society, foreign uncertainties, and the rate of technological advance. Total spending, at all levels of American government, is today about 40 percent of the Gross Domestic Product. The percentage has grown pretty...

Someone Give Richard Posner a Copy of the Catechism | The American Spectator
Richard Posner, the influential judge and law and economics scholar, has written a blog reaction to Pope Benedict XVI's recently publicized comments on condoms. Posner's argument (that the pope is probably going to have to OK condoms in the near future) has its own sort of internal logic, but it doesn't relate to anything in real life because all his facts are wrong. What's mystifying is that the concepts and facts that trip Posner up are not exactly obscure or hard to ascertain. If Posner had bothered simply to reference the Catechism -- the very first place one would look, and instantly accessible online -- he would have avoided most of the egregious errors he makes. Without going into the merits of Posner's overarching argument, here is an incomplete list of where he goes wrong in the piece, starting with the first sentence:
